Representatives of the prosecutor’s office of the capital’s region, representing the side of the Kyiv City Council, intend in court to seek the liberation of land, the total area of which is about 2 hectares near Lake Camel, in the Obolonsky district of the capital, and occupies the whole territory of the Society of Fishermen and Hunters.
The press service of the metropolitan prosecutor’s office reported that representatives of the specified company occupied the land without legitimate for this, the seizure of the territory was carried out unauthorizedly, due to the absence of any title documents on the land plot. The State Assembly Inspectorate established the specified fact as part of the audit during the last year.
A specialized recreation center under the name “Emerald” is located on the land plot. During the period of the year before last, the inspection on the state architectural and construction control of the metropolitan region established that the ownership of all structures were not registered.
The courts within the framework of two preliminary instances denied representatives of the prosecutor’s office to satisfy the relevant claim. Actually, they established that the company itself continues to use the land on the basis of a decision, which was provided by the Executive Committee of the Kyiv City Council in the distant 1986. Based on this solution, later a fishing base was built on the territory. Representatives of the Society of Hunters continue to use the site and the corresponding base, while the land tax is paid annually. It should be noted that the Supreme Economic Court decided to cancel the decisions of the two previous courts, and the case was sent for a new investigation, he was sent to the first court.
